General Terms and Conditions

Scope of Application
These General Terms and Conditions (hereinafter "GTC") in their current version apply exclusively to the business relationship between Bohn Ehrenberger OG (hereinafter "humanimal") and the participant. For reasons of readability, gender-specific formulations are omitted in these GTC. Where personal designations are only given in the masculine form, they refer equally to all genders.

The language of the contract is German.

Registrations
Registrations are considered in the order in which they are received. Humanimal accepts registrations for its events in writing via the homepage or by email. By registering, the participant accepts the GTC in their current version. Oral agreements are not valid. If course places are fully booked before the start, a waiting list can be created upon request.

Events are subject to minimum and maximum participant numbers. If an event consists of a series of events, registration for the entire series is required, unless individual registrations are offered; missed events cannot be made up for free.

Conditions of Participation
If attendance at an event is subject to specific admission requirements, these will be stated separately in the program and must be met by the participant. The right to attend an event cannot be transferred to third parties. The use of alias names is not permitted.

Event Location/Type
If events are held at a location requested by the customer, the customer is obliged to provide the necessary infrastructure and technical equipment. Otherwise, any additional or substitute costs incurred must be fully reimbursed to humanimal.

Event Fee
The full event fee must be paid no later than six weeks before the event starts. If this is not done, humanimal reserves the right to allocate the event place to someone else or to claim the outstanding event fee. Additional required materials, accommodation, and meals are included in the event fee, except for special offers. If registration is made within six weeks before the event starts, the full event fee is due immediately upon registration.

Cancellations must be made at least six weeks before the respective event starts. In this case, the fees paid will be refunded. In the event of a medically justified cancellation within the last four weeks before the seminar, fees already paid will be refunded upon presentation of a medical certificate. In all other cases, there is no entitlement to a refund of the event fee. Failure to pay the participation fee does not constitute a conclusive cancellation of the event. Non-attendance does not waive the obligation to pay. No reduction or prorated refund of the participation fee will be given for non-attendance, late arrival, or early departure, regardless of the reason.

Scripting, Work Materials
For many events, scripts or learning materials are available to participants, which are generally included in the fee and are distributed before or after the event, depending on the specific event. If it is not possible to provide the materials at the start of the event, for example, due to a last-minute booking, they will be provided as soon as possible. The separate purchase of learning materials from humanimal is not possible. The materials provided by humanimal may not be duplicated, distributed, offered for sale, made publicly accessible, or circulated.

Image, Video, and Audio Recordings
The making of image, video, and audio recordings of learning materials, lectures, or people during events and exams in person is strictly prohibited.

Certificate of Participation
Certificates of participation for attending the event will be issued free of charge.

Changes to the Event Program/Changes to Event Type (In-Person, Online Events)/Event Cancellation
Due to long-term planning, organizational changes to the program and event type may be necessary. The holding of an event also depends on a minimum number of participants. Humanimal therefore reserves the right to make changes to course days, start times, dates, venues, trainers (consultants), as well as to cancel events (consultations) if necessary. Participants will be informed in a timely and appropriate manner. In the event of cancellation of an event (consultation) due to illness of the trainer (consultant) or other unforeseen events, there is no entitlement to the event (or parts of it) being conducted. No compensation for incurred expenses or other claims against humanimal can be derived from this. The same applies to necessary short-term postponements or changes in the schedule.

If an event must be canceled, already paid event fees will be refunded in full. Humanimal will use the same payment method for the refund that was used for the original transaction unless expressly agreed otherwise with the participant.

Cancellation Policy
Participants may only cancel booked events in writing via email. The cancellation becomes effective on the day it is received by humanimal. The following cancellation conditions generally apply:

  • Cancellations up to 15 calendar days before the event: free of charge

  • Cancellations from the 14th calendar day before the event: 50% of the event fee

  • Cancellations on the event day or later: 100% of the event fee (this also applies in the case of agreed partial payments)

In the event of a cancellation, the amount will be refunded minus a processing fee of 5% of the event fee, provided the cancellation is made no later than 15 calendar days before the event. For cancellations after this period, the above-mentioned cancellation conditions apply.

Postponements
In the case of postponements by the participant, the cancellation conditions apply.

Right of Withdrawal
Participants have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded. To exercise the right of withdrawal, the participant must inform humanimal of the decision to withdraw from this contract by means of a clear declaration (e.g., a letter sent by post, fax, or email). The participant may use the withdrawal form template on our website (LINK) and submit it electronically. Upon the participant's withdrawal, humanimal will promptly send a confirmation of receipt of such withdrawal (e.g., by email). To meet the withdrawal deadline, it is sufficient to send the notification of the exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal
If this contract is withdrawn, all payments that humanimal has received in relation to the withdrawal will be refunded immediately and no later than fourteen days from the day on which humanimal received the notification of withdrawal. Humanimal will use the same payment method for this refund that was used in the original transaction unless expressly agreed otherwise with the participant; in no case will the participant be charged fees for this refund.

Disclaimer
Claims for damages against humanimal exist only in cases of intent and gross negligence. They also exist in cases of negligent violation of duties whose fulfillment is essential for the proper execution of the contract, whose violation endangers the achievement of the contractual purpose, and whose compliance the participant regularly relies on. In the latter case, liability for unforeseeable and atypical damages is excluded. Claims for damages due to slightly negligent violations of other obligations against humanimal are excluded. The above exclusions and limitations of liability do not apply to injuries to life, body, and health. Liability under the Product Liability Act remains unaffected.

No liability claims can be made against humanimal for the application of the knowledge acquired at humanimal or for the accuracy and timeliness of the scripts, contributions, or slide sets provided. Humanimal does not guarantee the accuracy of printed or written errors in its publications and web pages.

References
Companies that become contracting partners of humanimal grant humanimal the right to use the company name and logo for reference or advertising purposes.

Severability Clause
Should individual provisions of these GTC be invalid or unenforceable or become invalid or unenforceable after the conclusion, the validity of the remaining GTC remains unaffected.

Jurisdiction and Applicable Law
The competent court in Vienna, both in subject matter and locality, shall have jurisdiction. Amendments or additions to the GTC must be made in writing. This also applies to the waiver of the written form requirement. It is expressly noted that the right of the participant to offset liabilities is only permissible in the event of insolvency or for counterclaims that are legally connected to the participant's liabilities, have been legally established, or are recognized by humanimal.

Austrian law applies exclusively, excluding the conflict of laws provisions.
